By checking the box and/or digitally signing this agreement, you acknowledge that you have read, understood, and agree to the following Terms of Service ("Terms") between Pinnacle Online Marketing Pty Ltd ("Pinnacle," "we," "us," or "our") and you, the client ("User").

These Terms govern your access to and use of the Pinnacle software platform and related coaching, support, and marketing services ("Services").

1. Service Overview

Pinnacle is a "done-with-you" lead-generation and automation system. We provide access to our software, onboarding, support, and advisory coaching designed to help you implement your marketing and sales systems effectively. All coaching is advisory only — implementation and results depend on your own actions, market, and ad spend.

2. Trial Period & Initial Payment

Your access begins with a 10-day trial period for an upfront payment of $27. This payment is non-refundable and grants you full access to the platform, your Implementation Call, community, and support for 10 days from the date of purchase.

If you do not wish to continue after the 10-day trial, you must cancel in writing before the trial period expires (see Section 6). If no cancellation is received before the end of the 10th day, your account will automatically transition to the weekly subscription described in Section 3.

3. Minimum Term Commitment & Weekly Subscription

Upon transitioning from the trial period, you enter a fixed minimum commitment of 4 months (16 weeks), billed at $88 per week.

After the 16-week minimum period, the subscription automatically continues on a week-to-week basis at $88 per week unless cancelled in accordance with Section 6.

If you choose to cancel before the end of the 16-week minimum period, all remaining weekly payments for that period become immediately due and payable.

4. Payment Terms

Weekly subscription fees are billed to the active payment method on file every 7 days from the date your trial period concludes.

You authorise Pinnacle Online Marketing Pty Ltd to automatically charge your card each billing cycle until written cancellation is received and confirmed.

All payments are final and non-refundable once processed.

5. Overdue Accounts & Debt Collection

If your account remains unpaid for more than 45 days with no correspondence, the balance may be forwarded to an independent debt-collection agency without further notice.

You remain liable for all outstanding balances, regardless of any chargeback outcome or third-party payment dispute.

Any chargeback or reversal of payment will be treated as a breach of contract, and your account may be suspended or terminated immediately.

6. Cancellation Policy

Cancellations must be submitted in writing at least 7 days prior to your next scheduled weekly billing date.

Written notice must be sent to michael@pinnacleonlinemarketing.page.

Cancellations made after this window may result in one additional weekly billing cycle being charged.

Access to the platform will remain active until the end of the current paid period.

7. Communication Credits (Twilio Usage)

Each monthly equivalent of subscription payments includes a $30 communication credit, applied toward texts, calls, and emails — approximately 1,515 texts (60 characters each), 1,408 minutes of calls, or 28,571 emails.

When the credit is exhausted, an automatic $10 top-up will be billed to your card on file. Unused credits roll over.

Communication rates, credits, and pricing are subject to change without notice based on carrier and platform costs.

8. Ownership, Access & Intellectual Property

All data you input into your account remains your property.

All software systems, automations, workflows, funnels, domains, templates, and materials provided by Pinnacle remain the exclusive property of Pinnacle Online Marketing Pty Ltd.

Strictly one (1) user per account is permitted unless prior written authorisation is granted by Pinnacle management. Shared logins, sublicensing, or multi-user access under a single account is prohibited and may result in suspension or termination.

You agree not to copy, redistribute, resell, or share any proprietary components, templates, or automations.

9. Platform Dependencies

Pinnacle operates on infrastructure provided by integrated third-party services such as Twilio, Mailgun, ChatGPT, and others. By using the platform, you acknowledge that your use is also subject to the applicable third-party terms. Pinnacle is not responsible for downtime, performance issues, or losses arising from third-party providers.

10. Results Disclaimer

Selling an additional 10 cars per month is typical based on client data but not guaranteed. Results depend entirely on how the system is implemented, your market conditions, effort, and ad spend. Pinnacle makes no guarantee of income, profit, or sales performance.

11. Termination

Pinnacle reserves the right to suspend or terminate your access for non-payment, misuse, shared-account access, or breach of these Terms. Termination does not relieve you of any outstanding payment obligations.

12. Acceptance & Authorisation

By checking the acceptance box and/or digitally signing this agreement, you:

•Confirm that you have read, understood, and agree to all terms herein.

•Authorise Pinnacle Online Marketing Pty Ltd to charge your chosen payment method on a recurring weekly basis following the 10-day trial period.

•Acknowledge that all payments are final and non-refundable.

•Acknowledge that you are bound by the 4-month (16-week) minimum term and cancellation process.

SMS NOTE — Individuals Based in the United States & Canada

Due to regulations, accounts in the United States & Canada must be A2P compliant. We suggest two options:

1.We complete an A2P application, which takes an average of 72 hours (this is outside of our control).

2.Suggested — Our unlimited SMS solution (no extra charge from Pinnacle). This solution bypasses the need for A2P registration. Once logged into the dashboard, click Unlimited SMS on the Directory tab.
